– NATURA LIVING DECO SRL, registered in Bucharest County, Str. Ciobanasului 22, 3rd floor, apartment 4, J40 / 915/2020, CUI 42161622, share capital – 200 ron governed in accordance with Romanian law.

CONTENT has the following definition:

– all information on the SITE www.NaturaLiving.eu that can be visited, viewed or otherwise accessed by using digital equipment;

– the content of any e-mail sent to its USERS or CUSTOMERS by NaturaLiving.eu by electronic means and / or any other available means of communication;

– any information communicated by any means by an employee or collaborator of NaturaLiving.eu to the USER or CLIENT, according to the contact information, specified or not by him;

– information related to the products, services and / or tariffs practiced by NaturaLiving.eu in a certain period;

– information related to the products, services and / or tariffs practiced by a third party with which NaturaLiving.eu has concluded partnership contracts, in a certain period;

– data related to NaturaLiving.eu, or other privileged data thereof.

SERVICE – the e-commerce service conducted exclusively on the publicly available portions of the SITE, in the sense of giving the CUSTOMER the possibility to contract products and / or services using exclusively electronic means, including other means of distance communication.

MEMBER – The person who has or obtains access to the CONTENT, through any means of communication (electronic, telephone, etc.) or based on an agreement of use between NaturaLiving.eu and it and which requires the creation and use of an ACCOUNT.

REMOTE CONTRACT – according to the definition contained in GEO 34 of June 4, 2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing certain normative acts art. 2 point 7, as transposed by Directive 2011/83 / EU on consumer rights: any contract concluded between a professional and a consumer within an organized distance sales or service system, without the simultaneous physical presence of the professional and the consumer , with the exclusive use of one or more means of distance communication, up to and including the moment when the contract is concluded;

TRANSACTION – collection or reimbursement of an amount resulting from the sale of a product / service by NaturaLiving.eu to the Customer, by using the services of the card processor approved by NaturaLiving.eu or by bank transfer, regardless of the method of delivery.

  1. General

2.1. The document establishes the terms and conditions of use of the Site / Content / Service by the Member or Client, in case he does not have another valid use agreement, concluded between NaturaLiving.eu and him.

2.2. The use, including but not limited to accessing, visiting and viewing, the Content / Service implies the adherence of the Member or the Client to the present terms and conditions; The client undertakes to constantly monitor the terms and conditions that can be updated, modified and completed. 2.3. Access to the Service is made exclusively by accessing the publicly available NaturaLiving.eu website.

2.8. 3.1. 3.4. The Member or the Client may copy, transfer and / or use content only for personal or non-commercial purposes, only if they do not conflict with the provisions of this Document.

3.5. If NaturaLiving.eu grants the Member or the Client the right to use in the form described in a separate user agreement, a certain content, to which the Member has or obtains access as a result of this agreement, this right extends only to that or those contents defined in the agreement, only during its existence or these contents on the site or the period defined in the agreement, according to the defined conditions, if they exist and do not represent a contractual commitment from NaturaLiving.eu for the respective Member, Client or any other third party who has / obtains access to this transferred content, by any means and who may be or is harmed in any way as a result of this content, during or after the expiration of the user agreement.

3.6. No content transmitted to the Member or Client, by any means of communication (electronic, telephone, etc.) or acquired by him through accessing, visiting and / or viewing constitutes a contractual obligation on the part of NaturaLiving.eu and / or the employee or collaborator of NaturaLiving.eu which mediated the transfer of content, if any, to that content.

3.7. Any use of the Content for purposes other than those expressly permitted by the document or the accompanying use agreement, if any, is prohibited.

  1. Contact for Clients and Members

4.1. NaturaLiving.eu publishes on the site the complete and correct identification and contact data by the Client or Member.

4.2. By using the contact form or the service present on the site, the Member or the Client automatically allows NaturaLiving.eu to contact him by any available means including the electronic means.

4.3. The partial or complete completion of the contact form and its sending does not represent in any way a commitment on the part of NaturaLiving.eu to contact the Member or the Client.

4.4. Accessing the Site, using the information presented in it, visiting the pages or sending e-mails or notifications addressed to NaturaLiving.eu is done electronically, by telephone, or any other means of communication available to the Member or Client and NaturaLiving.eu , thus considering that it consents to the receipt of notifications from NaturaLiving.eu in electronic and / or telephone manner, including communications by e-mail or through announcements on the site.

  1. Newsletters and alerts

5.1. When the Member or the Client creates an Account on the Site, accepting the Document (Terms and Conditions), he has the right to express or not his agreement regarding the receipt of newsletters and / or alerts from NaturaLiving.eu.

5.5. NaturaLiving.eu reserves the right to select the persons to whom it will send newsletters and / or alerts as well as the right to remove from its database any Member or Client who has previously expressed its consent to receive newsletters and / or alerts, without any subsequent commitment from NaturaLiving.eu, or any prior notice thereof.

5.6. NaturaLiving.eu will not include in newsletters and / or alerts sent to the Member or the Client, any other advertising material in the form of content that refers to a third party that is not a commercial partner of NaturaLiving.eu, at the time of sending the newsletter- and / or alerts.

  1. Privacy Policy

6.1. NaturaLiving.eu may collect personal data and special data on the pages of its Sites, only with the voluntary consent of the Member or the Client, for the following purposes:

– validation, shipment and invoicing of orders to it (NaturaLiving.eu conditions by written or telephone confirmation the shipment of the first order for a new Account, for data compliance);

– after the validation of the order, for the transmission of information regarding the products, delivery periods, cancellations or problems of any nature related to an order or a contract, to the services or products purchased by it;

By creating the Account, each Member or Client has expressed his consent for NaturaLiving.eu to collect and manage his personal data, under the conditions and in compliance with the provisions of Law 677/2001. Any Member or Client has the right to obtain from NaturaLiving.eu, through a written request, signed and dated, free of charge:

  1. a) confirmation that the data concerning him are or are not processed at a certain moment;
  2. b) as the case may be, the rectification, updating, blocking or deletion of data whose processing is not in accordance with the law, especially of incomplete or inaccurate data;
  3. c) as the case may be, the transformation into anonymous data of the data whose processing is not in accordance with the law;
  4. d) the notification to the third parties to whom the data of any operation carried out according to letter b) or c), if this notification does not prove impossible or does not involve a disproportionate effort compared to the legitimate interest that could be harmed.

Any Member or Client has the right to oppose at any time, for well-founded and legitimate reasons related to his particular situation, by sending to NaturaLiving.eu a written request, dated and signed, that the data concerning him to make the object of a processing, except in cases where there are contrary legal provisions. In case of justified opposition, the processing can no longer target the data in question.

Any Member or Client has the right to object at any time, free of charge and without any justification by sending to NaturaLiving.eu a written request, dated and signed, that the data concerning it be processed for the purpose direct marketing, on behalf of the operator or a third party, or be disclosed to third parties for such purpose.

6.2. 6.3. The customer has the right to object to the collection of his personal data and to request their deletion, thus revoking his consent for the document, and thus waiving any implied rights specified therein and without any subsequent obligation of any party to the other or without any party may claim damages from the other, but only in accordance with art. 2.8.

6.4. For the exercise of the rights according to art. 6.3, the Client or the Member will address NaturaLiving.eu, according to the contact data available on the site, valid on that date.

6.5. Using the forms available on the site, the Client or the Member has the right to modify the data that he initially declared in order to reflect any change that has occurred, if any.

6.6. If the Customer opts for online payment by card of the value of orders, contract and / or contracts, the authorization and remittance for settlement of card acceptance transactions is made exclusively through the company  S.A. through the integrated solution; Stripe Inc. is the provider of NaturaLiving.eu software solution to facilitate electronic commerce, ie payment services, payment administration and anti-fraud protection.

All types of cards issued by Romanian and foreign banks under the VISA and MasterCard logos are accepted, provided that the issuing banks have activated them for online payment. Credit card payments are also accepted for installment payments as listed on the payment information page. Other payment method is bank transfer.

6.7. NaturaLiving.eu does not request or store any information regarding the Client’s bank card or cards, these being processed directly on the servers of the online payment service provider.

6.8. NaturaLiving.eu’s privacy policy refers only to the data provided voluntarily by the Client or Member exclusively on the site. NaturaLiving.eu is not responsible for the privacy policy practiced by any other third party that can be reached through links, regardless of their nature, outside the site.

6.9. NaturaLiving.eu undertakes that the collected data of the Client / Member will be used only in accordance with the stated purposes and not to make public, sell, rent, license, transfer, etc. database containing information regarding the personal or special data of the Member / Client of any third party not involved in the fulfillment of the stated purposes.

6.10. Exception from the provisions of art. 6.9 will make the situation in which the transfer / access / viewing / etc is requested by the competent bodies in the cases provided by the regulations in force at the date of the event.

6.11. Bank card processor approved by NaturaLiving.eu, Stripe Inc. has the right to access / view any type of data / documents, generated as a result of an issued order, canceled orders, contract, canceled contract or an honored contract, in order to investigate any Transaction, if any.

6.12. NaturaLiving.eu guarantees that the personal data of a User, collected through the contact form, will be used only until the solution of the problem is communicated to him, after which they will become exclusively statistical data.

6.13. NaturaLiving.eu is not responsible for defects that may jeopardize the security of the server on which the database containing this data is hosted.

  1. Online sales policy

7.1. Access to the service

7.1.1. Access to the service is allowed to any Member who owns or creates an Account on the site

7.1.2. In order to be allowed access to the service, the Member will have to accept the provisions of the Document.

7.1.3. NaturaLiving.eu reserves the right to limit the customer’s access to the Service and marketing campaigns (not to include him in the promotion and loyalty campaign, to allow him to order only with advance payment, etc.) as well as the right to cancel orders already placed if it considers that based on the behavior of the Customer (placing and refusing more than two orders in the payment system on delivery, placing orders that are subsequently canceled or modified except in cases permitted by art. 7.3 .7, the use of biased language, infringement of intellectual property rights, etc.), access and the existence of the Client’s Account could harm NaturaLiving.eu in any way. This right can be exercised at any time and it is not necessary to notify the Client in this regard.

7.1.4. Each Member may have only one Account. It is forbidden to share an Account between several Members / Clients.

7.1.5. In the event that accesses shared by several Customers are discovered, NaturaLiving.eu reserves the right to cancel or suspend the Client’s access to the Content or Service. If orders are placed from suspended or canceled accounts, they will be automatically canceled.

7.1.6. NaturaLiving.eu may refuse an order following a prior notification addressed to the Customer, without any obligations between the parties and without a party being able to claim damages, for the following situations:

– failure / invalidation of the online transaction;

– non-acceptance by the issuing bank of the Client’s card / transaction;

– providing incomplete or incorrect data by the Client;

– the Client’s activity may cause damage to the NaturaLiving.eu site, to Natura Living Deco Srl and / or to its partners;

– The customer uses the Service in a manner inconsistent with normal usage and good faith or exercises his rights in order to harm or damage NaturaLiving.eu or in an excessive and unreasonable manner, contrary to good faith;

– Consecutive deliveries failed due to the Client’s fault;

– other justified reasons (eg: placing an unjustified waiver of more than three orders within 30 days).

7.2. Products and services

7.2.1. NaturaLiving.eu may publish on the site information about products, services and / or promotions practiced by it or by any other third party with which NaturaLiving.eu has concluded contracts or partnership agreements, within a certain period and within the available stock.

7.2.2. The products and / or services purchased through the service are intended exclusively for the personal use of the Customer.

7.2.3. NaturaLiving.eu may limit the ability to purchase products or services available on the Site at any given time to one or more Customers for good cause.

7.2.4. All tariffs related to the products or services presented on the site are expressed in euro (EUR) and are final.

7.2.5. The PRP price means the price recommended by the manufacturer for sale in stores, shopping malls or any other commercial space where no discounts are applied. These tariffs are purely informative and have no legal value, not being assimilated and not included in the sales at a reduced price, as they are defined by OG 99/2000 regarding the marketing of market products and services.

7.2.6. The invoicing of the purchased products is done exclusively in EUR using the information provided by the Client in the intended form. NaturaLiving.eu is not responsible for the correctness of the information provided by the Customer for the invoice. The invoices are issued as follows: for the payments made before receiving the products and services, the pro forma invoice is issued and for the payments made at the time of receiving the products, the final invoice is issued. Cancellation invoices are issued for corrections (cancellations, returns). All invoices are issued and recorded automatically and included in the tax reports. Corrections are only accepted as modifications to the invoices issued only within the specified limits.

7.2.7. Payment for products and / or services purchased through the service can be made both online by debit card or by bank transfer.

7.2.8. In the case of online payments by card, NaturaLiving.eu is not / cannot be held responsible for any other additional costs borne by the customer, including but not limited to currency conversion fees applied by the bank issuing his card, if the currency of its issuance differs from the currency of the European Union.

7.2.9. Cash on delivery (courier) is a payment method which is not available outside Romania.

7.2.10. The information from the sales events used to describe the products, characteristics and weight available on the site (static / dynamic images / multimedia presentations / links to other sites, etc.) do not represent a contractual obligation on the part of NaturaLiving.eu, these being as a presentation . NaturaLiving.eu may withdraw a product offer or modify it at any time until the order is placed, without owing any damages or other penalties to any potential customer.

7.2.11. In the images of NaturaLiving.eu products and / or services, it reserves the right to use other products (accessories / etc) that may not be included in the costs of the respective products and implicitly will not be delivered when purchasing the products. In this case, it is expressly stated in the description of the products what good is for sale and it is also marked in the image.

7.2.12 In the unlikely event that NaturaLiving.eu will not be able to honor some of the products, it will notify the Customer by e-mail, offering one of the alternatives:

  1. canceling the order or removing from the order the product that can no longer be delivered; the specific amount will be automatically returned to the card with which the initial payment was made
  2. receiving a voucher on the site for purchases produced only on NaturaLiving.eu

7.3. Online order

7.3.1. The customer can place orders for products sold at a given time, exclusively on the site, the offers being limited in time (after the indicated period no more orders can be placed and the items are no longer visible on NaturaLiving.eu). The price displayed on the site at the time of the order will not change, being firm. Orders can no longer be placed for an expired offer.

7.3.2. By completing the order, the Customer agrees that all the data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the order, named in this document and the order issued.

7.3.3. The distance contract is considered concluded by NaturaLiving.eu when the order placed by the Customer is confirmed electronically by NaturaLiving.eu, following the receipt of all products (in terms of quantity and quality) from that order by NaturaLiving.eu (directly or through subcontractors). Moreover, before validating the Customer’s order and before shipping the products, NaturaLiving.eu has the right to contact the Customer, by any means available / approved by NaturaLiving.eu (by phone or e-mail), in order to obtain personal confirmation from Customer of his identification and delivery data. Customers agree that NaturaLiving.eu cannot be forced to validate / deliver products to persons who have not confirmed delivery and identification data.

7.3.4. NaturaLiving.eu will unilaterally terminate and automatically cancel the order placed by the Customer, even without prior notice to the Customer, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other in the following cases: non-acceptance of the transaction by the issuing bank of the Client’s card, in case of online payments; invalidation of the transaction by the card processor approved by NaturaLiving.eu, in case of online payment; the data provided by the Customer regarding the delivery (address, contact data) on the site are incomplete or incorrect; the Client’s activity on the site may and / or cause damages of any kind on the part of NaturaLiving.eu and / or its partners; making more than two consecutive failed deliveries; for other objective reasons.

7.3.5. In case the Client cancels an order with payment made in advance, by confirmed bank transfer or by the online card payment solution and in which the bank issuing the Client’s card has authorized the bank transaction, this amount will be refunded by NaturaLiving.eu within a maximum of 14 days from the date on which NaturaLiving.eu became aware of this fact or may be converted into NaturaLiving.eu credits under the conditions of art. 7.9.5 at the request of the Client.

7.3.6. If some products ordered by the Customer through an order made with payment made in advance (by confirmed bank transfer or online card payment solution) are no longer available in stock for reasons independent of NaturaLiving.eu, NaturaLiving.eu will inform the client on this fact as soon as it knows the unavailability and will order the reimbursement of the amounts paid in advance within maximum 14 days from the notification of the client. In this situation, NaturaLiving.eu reserves the right to offer, in addition to the amounts due refundable in advance, promotional offers (free of charge) for any product that has been ordered and become, after confirming the order and for reasons independent of NaturaLiving.eu, not available for delivery. The use of promotional offers can be done only on NaturaLiving.eu and is conditioned by the standard behavior of the client;

7.3.7. A placed order can be modified only in the following situations and only at the Client’s request. The client will request this in writing, sending an e-mail to [email protected] clearly mentioning the request and the order number.

  1. The customer gives up a product and notifies NaturaLiving.eu before sending the order
  2. Increasing the quantity of an existing product in an order, a product that is in an active campaign at the time of requesting the additional order
  3. Delayed delivery by a maximum of two weeks above the maximum delivery limit
  4. Change of delivery address
  5. Modification of the payment method
  6. Change billing data. For invoices already issued, no changes can be made regarding the legal / natural person (replacement with a new person), only corrections (of the company’s name / name, contact details, etc.).

7.3.8. The orders cannot be modified, in case the Client opts for the online payment or by bank transfer of their equivalent value.

7.3.9. If a Customer modifies his personal data, using the forms available on the site, all orders in progress at that time will keep his data defined / accepted by the Customer before the time of the change, taking into account for delivery and contact the new data modified accordingly.

7.4. Telephone order

7.4.1. Customer / Member cannot place telephone orders. The customer / Member cannot request a change of order on the phone.

7.5. Contract and completion

7.5.1. NaturaLiving.eu will issue and transmit to the Client all the necessary documents attesting the purchase of the products / services by the Client according to the legislation in force.

7.5.2. NaturaLiving.eu will facilitate the Client’s information on the completion stage of his order by sending an information e-mail to the address indicated by him. The issued invoice will include all the obligatory mentions in accordance with art. 319 of Law no. 227/2015 on the Fiscal Code.

7.5.3. The contract to which are added the documents certifying the delivery to the Client of the package by the courier (AWB signed and settled) from NaturaLiving.eu becomes an honored Contract.

7.5.4. The contract is concluded for a determined duration. It shall be deemed to have ceased at the moment when the parties have fulfilled their mutual obligations within the terms and conditions established by this Document.

7.5.5 If there are differences between the list of products delivered and the contents of the package, the Customer has the obligation to notify NaturaLiving.eu and the courier (if the finding was made in his presence) within 24 hours upon receipt of the package by telephone or by e-mail to [email protected] with the related details (photo, explanations, etc.). If the Client has not made the finding in the presence of the courier, he can NOT invoke the differences. The products will be your responsibility from the completion of delivery. Once a product has been received by you all risk of damage to, or loss of, the product shall pass to you.

7.6. Transport

7.6.1. The delivery to the Customer of the products purchased from NaturaLiving.eu, is made only through the express courier system.

The delivery price of the products practiced by NaturaLiving.eu will be calculated by the end of the order depending on the weight of the package. The customer can check the number of shipments of an order and their status in the My Account section on NaturaLiving.eu. NaturaLiving.eu does not guarantee in any way that an order is sent in a single shipment and does not charge additional fees for delivery in two shipments. The way of packaging and delivery is at the free choice of NaturaLiving.eu, respecting the obligation of full delivery of the products during the assumed period.

For bulky packages, NaturaLiving.eu does not add a handling fee.

Under certain conditions NaturaLiving.eu may offer free shipping (depending on the value of the order or other promotional activities). NaturaLiving.eu cannot be obliged in any way to offer free transport if the Client does not comply with the standard conditions of use of NaturaLiving.eu services.

7.6.2. The delivery time of an order is expressly communicated when placing it and is an interval of days influenced by: processing times in the NaturaLiving.eu warehouse, working days of the month, number of products in the order and processing times of each product, etc. As a rule, products in one order are delivered in a single package with a single AWB (products in one order are not partially delivered).

Deliveries will usually be made within the period assumed when placing the order (varies between 1 day and 4 days) and the Customer can obtain information on the status of delivery at any time. If the product / products cannot be delivered in the estimated delivery time, NaturaLiving.eu will immediately inform the Customer by E-mail offering two options: The Customer can either cancel (in writing) the order / product or accept the new proposed delivery time. In the event that the payment was made in advance of delivery and the Customer opts for canceling the order, the amounts paid will be reimbursed in full according to law, within a maximum of 14 days from the date of cancellation.

7.6.3 The customer may receive as a promotional offer, free delivery for the purchase of goods with a total value over 500 EUR, only under certain conditions, including but not limited to:

  1. package weight less than 15 kg
  2. maintaining the order in the initial formula (without modifications / postponements)
  3. in case of return, the Client converts the amounts into vouchers

The offers are communicated and accepted at the time of placing the order. Freebies are not required for NaturaLiving.eu.

7.7. Quality and guarantees

7.7.1. NaturaLiving.eu complies with the warranty provisions according to the Romanian legislation in force. Clear details regarding these warranties are given in the product data sheets and no member can claim an extended warranty other than the one mentioned. The guarantee applies to the normal conditions of use and is valid only for the products purchased and paid for by the Client from NaturaLiving.eu. The products benefit from a guarantee of conformity according to the provisions of Law 449/2003, as it transposed in Directive 1999/44 / EC on the sale of consumer goods and related guarantees or if there is an extended warranty period specified in the presentation of the product, then the longer term may apply. The responsibility of NaturaLiving.eu, according to the provisions of art. 9-14 of Law 449/2003 is employed if the lack of conformity appears within a period of 2 years, calculated from the delivery of the product. The guarantee implies the reimbursement of the value for the non-compliant products for which the Client notifies the trader in writing within the legal term; NaturaLiving.eu does not replace or repair defective or non-compliant products. Non-compliant products become the property of NaturaLiving.eu. The customer is not entitled to compensation or penalties for non-compliant products and by placing the order declares that he agrees to receive the value of the products and transport in case of non-compliance.

7.7.2. Clear details about the characteristic features of each product are provided on the site. The client is obliged to follow the indications from here. Information on the terms and conditions of the NaturaLiving.eu warranty and the general instructions for use of the various types of products may be provided to the Customer as a document available at NaturaLiving.eu, by e-mail or in the form of a brochure inserted in each package (case by case). If this information has not reached the Client, he can obtain it at any time by telephone or e-mail to [email protected]

7.8. Waiver of contract and return of products

7.8.1. Except for the limitations of art. 7.9 regarding the purchase with NaturaLiving.eu credits, the NaturaLiving.eu Client may return the products purchased through a Contract and is entitled to receive the full value paid for the products, in the following situations: The products show severe damage that makes them non-compliant; The delivered products are different (specifications, quantity, etc.) from the placed order; The products have manufacturing defects The customer withdrew from the contract within 14 days from the date of delivery of the order. Thus, NaturaLiving.eu maintains the minimum term of 14 days provided in art. 9 of GEO 34 of June 4, 2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing normative acts

7.8.2. NaturaLiving.eu does not offer free delivery costs for returned products. The buyer will bear the direct cost of returning the products. The return is requested and processed through the My Account section on NaturaLiving.eu. The client will receive the cost of the return shipping by email according to art. 13 paragraph 3 and art. 14 of the Emergency Ordinance no. 34 of June 4, 2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing some normative acts. Then the products will be taken over and shipped by the express courier indicated by Natura Living Deco Srl.

7.8.3. Before the expiration of the withdrawal period, the Client informs NaturaLiving.eu about his decision to withdraw from the contract. For this purpose, the Client can choose one of the following options:

  1. a) to use the model withdrawal form available on the NaturaLiving.eu website in the Return section;
  2. b) to make any other unequivocal statement in which he expresses his decision to withdraw from the contract.

7.8.4. The customer who has notified NaturaLiving.eu in accordance with Article 7.8.3, has the responsibility to ensure that the products to which he referred have been returned or handed over to NaturaLiving.eu or express courier company indicated in the return form on NaturaLiving.eu), without undue delay and within a maximum of 14 days from the date on which it communicated NaturaLiving.eu its decision to withdraw from the contract. The term is respected if the products are shipped by the Customer before the expiration of the period of 14 days properly packaged for protection during transport.

7.8.5. The NaturaLiving.eu client will not be able to return the purchased products and / or will not claim any other damages in the following situations: If the return request for any of the situations provided in art. 7.8.1 has the date of dispatch of the notification of the intention to return which exceeds the period of 14 days provided according to art. 7.8.2, calculated from the working day following the date of the honored contract. In case a product is returned, having as motivation one of the situations provided in art. 7.8.1, and the returned product is not in the same condition in which it was delivered (with the accompanying documents, with all components). If the products were made according to the specifications presented by the Customer or clearly customized. If sealed products have been ordered and delivered which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the Customer (these products are: coconut bowls and candles). If products have been ordered and delivered that are, after delivery, according to their nature, inseparably mixed with other elements.

7.8.6. The Member / Customer will be informed in the e-mail of placing the order if it is returnable or not and if there are costs in case of return. Products that are a kit / set must be returned as a kit / set.

7.8.7. In case of withdrawal of the Client from the contract, NaturaLiving.eu will reimburse him all the amounts he received as payment from him, including, as the case may be, the delivery costs, without undue delay and, in any case, no later than 14 days from the date on which he is informed of the decision to withdraw from the contract.

  1. Fraud

8.1. NaturaLiving.eu does not ask its Clients or Users by any means of Communication (e-mail/telephone/SMS/ etc.) for information related to confidential data, bank accounts/cards or personal passwords.

8.2. Exception to art. 8.1 is only made to Clients who are legal entities, for the purpose of obtaining by NaturaLiving.eu the account number, respectively the bank of the Client, in whose name an Order will be invoiced.

8.3. The Customer assumes full responsibility for the disclosure to a third party of its confidential data.

8.4. NaturaLiving.eu disclaims any liability in the event that a Client is/is harmed in any way by a third party claiming to be/representing the interests of NaturaLiving.eu.

8.5. The Client shall inform NaturaLiving.eu of any such attempts using the contact details.

8.6. NaturaLiving.eu does not promote SPAM. Any Customer who has explicitly provided his/her email address on the site may opt-out of this.

8.7. Communications made by NaturaLiving.eu by electronic means of Remote Communication (i.e. e-mail) contain the sender’s complete and correct identification data or links to them at the time of transmission of the content.

8.8. The following purposes achieved or not achieved will be considered as an attempt to defraud the site/content and/or NaturaLiving.eu and criminal investigation will be initiated against the person(s) who attempted to or achieved such purpose(s):

8.8.1. to access data of any kind of another Customer through the use of an account or by any other method.

8.8.2. alter or otherwise modify the content of the Site or Content sent by any method by NaturaLiving.eu to the Customer

8.8.3. to affect the performance of the server/servers on which the Site runs

8.8.4. access or disclose to any third party who does not have the necessary legal authority, the content sent by any means by NaturaLiving.eu to the Client when it is not the legitimate recipient of the content.

  1. Limitation of liability

9.1. NaturaLiving.eu shall not be liable to any person or entity using or relying on the Content.

9.2. NaturaLiving.eu cannot be held responsible for any kind of damage (direct, indirect, accidental or otherwise) resulting from the use or inability to use the information of the type of content presented or not presented on the site or for any kind of errors or omissions in the presentation of the content that may lead to any kind of loss.

9.3. If a Customer believes that any Content sent by any means by NaturaLiving.eu infringes copyright or any other rights, the Customer may contact NaturaLiving.eu for details as per the contact details so that NaturaLiving.eu can make an informed decision.

9.4 NaturaLiving.eu does not grant the Customer access to the Site or the Service and does not grant the Customer the right to download or modify any Content in whole or in part, to reproduce any Content in whole or in part, to copy or otherwise exploit any Content, or to transfer to any third party any Content to which it has and/or has obtained access under a User Agreement, without the prior written consent of NaturaLiving.eu.

9.5. NaturaLiving.eu is not responsible for the content, quality or nature of other sites reached through links from the content, regardless of the nature of such links. For those sites, the responsibility is borne entirely by their owners.

9.6. NaturaLiving.eu is exonerated from any liability in case of use of the sites and/or the content transmitted to the Client by any means (electronic, telephone, etc.), through the sites, e-mail or an employee of NaturaLiving.eu, when this use of the content can or causes damages of any nature on the part of the Client and/or any third party involved in this transfer of Content.

9.7. NaturaLiving.eu does not give any direct or indirect guarantee that:

– the service will be suitable for the Customer’s requirements

– the service will be uninterrupted, secure or error-free of any kind

– the products obtained free of charge or for a fee through the service will meet the customer’s requirements or expectations

9.8. The operators, administrators and/or owners of the site are in no way responsible for the relationships or their consequences resulting from, but not limited to, purchases, special offers, promotions, promotions, or any other type of relationship / link / transaction / collaboration / etc. that may arise between the customer and any of those who promote themselves directly or indirectly through the site.

  1. Major force and fortuitous event

10.1. Unless expressly provided otherwise, neither party to a contract concluded pursuant to Article 7.4.8. which is still in progress shall be liable for failure to perform on time and/or properly, in whole or in part, any of its obligations under the contract, if the failure to perform such obligation was caused by an event of major force.

10.2. The party or the legal representative of the party invoking the aforementioned event is obliged to inform the other party immediately and in full of its occurrence and to take any measures at its disposal to limit the consequences of such event.

10.3. The party or the legal representative of the party who invokes the above-mentioned event shall be released from this obligation only if the event prevents him from carrying it out.

10.4. If within 15 days from the date of occurrence of the event, the said event does not cease, each party shall be entitled to notify the other party of the termination of this contract without either party being entitled to claim any further damages.

10.5. The party claiming major force must prove the impossibility of performance within 30 days from the date of the event but within the limits of Article 10.3.

  1. Disputes

11.1. By using/viewing/viewing/etc. the sites and/or any content sent by NaturaLiving.eu to the Member/Customer by accessing and/or sending by any means (electronic, telephone, etc.), the Member/Customer agrees at least to these “Terms and Conditions”.

11.2. Any dispute regarding these Terms and Conditions that may arise between the Member/Customer and NaturaLiving.eu shall be settled amicably.

11.3. NaturaLiving.eu shall not be liable for any loss, costs, suits, claims, expenses or other liabilities, if they are directly caused by the breach of the Terms and Conditions.

11.4. Any dispute of any kind (excluding art. 11.2) that may arise between the Member and NaturaLiving.eu or its partners shall be settled amicably. If this is not possible, the conflict will be solved in court, in accordance with the Romanian laws in force.

11.5. If any of the above clauses shall be found void or invalid, regardless of the cause, this clause shall not affect the validity of the other clauses.

11.6. This document has been drawn up and shall be interpreted in accordance with European law.

12.2. NaturaLiving.eu cannot be held responsible for any errors occurring on the site due to any cause, including changes, settings, etc., which are not made by the site administrator.

12.3. NaturaLiving.eu reserves the right to place advertising banners of any kind and / or links on any page of the site, in compliance with the legislation in force.
